Public Body Liability
In Crimmins the High Court identified the factors to be considered when establishing a duty of care in novel cases involving public body liability:
• Reasonable Foreseeability
• Defendant’s knowledge of the risk
• Plaintiff’s vulnerability (inability to protect against loss)
• Defendants’s control of the plaintiff
• Policy making function of the body
• Supervening reasons in policy not to impose duty
